expand_moreAlright, I need to rewrite my ToS so that I have it better laid out and also so you don't have to go to TH to find the damn thing. I'm going to update a few things here and there and add some things.
For clarity: most of this is to both protect me and protect potential buyers.
adoptables
- Unless worked out ahead of time, payment must be received in full within 24 hours. I will only do payment plans on purchases over 100 USD.
- All add-ons should be completed within a month(Ideally, they should be completed within a week). If I cannot complete them, I am obligated to discuss either giving the buyer a refund on the uncompleted work or working out some other form of repayment.
- I do not allow commercial use on designs purchased for under 100 USD. This is purely because I believe it's unethical to use a design for commercial purposes that barely got the designer a meal.
- If uploading to TH or similar site, do not credit redesigners for the original design. That is, I should maintain creator credit for designs I have made. You can, of course, include additional credits for the redesigns. I've just had bad experiences in the closed species community where my credits were simply thrown out due to a redesign or simply the same design but drawn in a different style.
- Do not turn my designs into an original species without talking to me first. I will rarely say no, but it's polite to ask.
- Please draw my designs at least once before reselling anything you got for free or via a trade.
- Do not resell my designs for more than what you paid for plus the value of any art paid for/made by you. At the very least, if you do, please don't massively inflate the price. Be nice to your fellow OC-havers.
- Do not put my designs up for FOBO(free or best offer). Especially if they were a freebie. It feels weird and gross to me.
Species designs
- If you buy one of my species concepts, you're allowed to make adopts or a community for it.
- If you intend to make a species I designed into a closed species, I tend to charge more. Generally this is listed in a design's pricing options.
- Do not edit my art.
- Once a species is paid for, you can change whatever you want with the design, add lore, and make adopts.
- Like with adopts, if you paid less than 100 USD, assume that commercial use is not included minus adopts. Again, this is so that I'm getting more than a meal or two from a single design.
Commissions
- Payment is expected before I line your art.
- I have the right to refuse any commission I feel uncomfortable with.
- If you pay before I even get a chance to see what you are asking for, you will be refunded and refused service. This is unlikely, as I will generally not give payment info until after I have had a chance to look over your order.
- I do not do sexual/pornographic/fetish art. Do not ask. I don't like drawing that type of art for other people. I respect that you have kinks, it's just not the kind of art I personally like to draw for others.
- I will charge more for art being commissioned specifically for a commercial purpose. Otherwise, my art is for personal use only.
- Again, don't edit my art. I generally do not delete my layered files unless I need to or it's a few years old, so if there's something you want altered later on, just shoot me a message and I'll see if I still have the file. If it's a minor edit, I can do that free of charge so long as the file still exists. I'll only charge for edits if it's huge changes, otherwise you could just commission me for a redraw(At a discount).
- My art is never for use in NFTs or AI. If you see my art in either, it was not used with my knowledge or permission.
- My turn around time tends to be around a week. you'll get WIPs at multiple steps to ensure that the art is to your specifications.
- If a commission is paid for, but cancelled before the lining stage, you get a full refund. If the art is at least lined, you will get a partial refund and the lines.
Notes
- I use paypal for payment
- Do not pay me via friends and family. This can put both our accounts at risk.
- I cannot revoke ownership of any of my designs for any reason other than a chargeback.
- Do not do a chargeback without talking to me first.
- I do not do a public blacklist. If I blocked you, then you're not allowed to get new art from me. If you try to get someone to get around the block to get art in your stead, they will join you in blockville. Public blacklists feel too much like public shaming and I don't want anything to do with that.
- I do do art trades, just ask me. I do not care about skill differences, as long as you complete your side. All I care about is what workload you already have(seriously, do not take on like a dozen pieces. Be kind to yourself)(Please contact me on TH about these for the fastest response)
- I will not track you down to make sure you're using some design you bought off me. It's really weird when people do that. It gets into stalker territory.
- Do not auth me or send me auth keys if you're privating one of my designs on TH unless we regularly communicate. Again, the act of tracking down every single design one makes is weird. There is no reason for me to know about where each and every one of my designs are or how they're being used.
- This does mean that if someone is using my design in a way that is harmful or you find objectionable, I probably have no clue. And frankly, I don't revoke designs, so pretty much assume that how someone uses their design has nothing to do with me as a person. Most I'll do is block and privately blacklist because, again, I don't revoke someone's ownership of my designs.
- Do, however, feel free to show me art you've done of designs you've bought from me if that floats your goat.
(Edited on june 5th, 2025 to rephrase and split apart a general rule. Said change is mostly about OC privacy and sharing your work. These changes do not do anything to add restrictions.)
